These terms set out the basis on which SmartAuto Garage Ltd. carries out work on your vehicle, sells parts and accessories, and operates smartauto.ie. Please read them before you book. By booking an appointment, leaving a vehicle with us or authorising work, you agree to them.
Nothing in these terms takes away the rights you have under Irish consumer law. Where any clause conflicts with those rights, your statutory rights apply.

2. How these terms apply
These terms apply to every service we carry out, every part we supply and every use of our website. They replace any earlier terms between us.
A contract comes into existence when we confirm your booking or, where no booking was made in advance, when we accept your vehicle into the workshop. No other document, note or verbal comment varies these terms unless we confirm the change in writing.
If any part of these terms is found to be unenforceable, the rest continues to apply.
3. Booking an appointment
You can book by telephone, by WhatsApp, by email or in person. We will confirm the date, the work to be carried out and, where possible, an estimated price and duration.
We ask that you arrive within the agreed window and leave the vehicle with us for the period we indicate. Where a vehicle arrives late or is not left long enough for the work to be completed safely, we may need to rebook it.
Please tell us at the time of booking about anything that affects the job, including known faults, previous repairs, aftermarket modifications, non-standard parts, immobilizers, security codes and any tracking device fitted to the vehicle.
We may ask for a deposit on work that involves ordering non-returnable or vehicle-specific parts. Where a deposit is taken, we will tell you at the time whether it is refundable.
4. Estimates, quotations and prices
An estimate is our considered view of what a job is likely to cost, given what we know before we start. It is not fixed. The final invoice may differ where the work turns out to be more or less involved than expected.
A quotation is a fixed price for a defined piece of work, valid for 30 days unless we state otherwise. We will only issue one where the scope is clear enough to price with confidence.
All prices are quoted in euro and include VAT at the applicable rate unless we state otherwise. Prices for business customers may be quoted excluding VAT, in which case the invoice will show VAT separately.
Where the cost of a job is likely to exceed an estimate by more than a modest margin, we will stop and contact you before continuing. We will not simply carry on and present a larger bill.
5. Authorising the work
We carry out only the work you have authorised. Authorisation may be given in person, by telephone, by WhatsApp or by email, and we keep a record of it.
If you are not the registered owner or keeper of the vehicle, you confirm by leaving it with us that you have the owner’s permission to authorise the work and to accept these terms on their behalf.
Please give us a telephone number on which you can be reached during the working day. If we cannot reach you to authorise a decision, the vehicle may sit unworked and may still incur storage charges under section 13.
6. Additional work found during a job
Vehicles frequently reveal further faults once work begins. A seized fastener, a worn component behind a panel or a related failure discovered during dismantling is common rather than exceptional.
Where we find additional work, we will contact you, explain what we have found, tell you what it will cost and ask whether you want it done. We will not proceed without your agreement.
If you decline additional work that we consider makes the vehicle unroadworthy or unsafe, we will tell you so clearly, note it on your invoice, and reserve the right to decline to carry out the remaining work or to release the vehicle only on the basis that you have been advised.
7. Diagnostic investigation
Diagnostic work is charged for the time spent investigating, whether or not it identifies a definitive fault. Modern vehicle systems are complex, intermittent faults may not present themselves during testing, and a stored fault code indicates a symptom rather than a cause.
We will agree a diagnostic time allowance with you before starting, and we will contact you before exceeding it.
Where diagnosis leads to a repair carried out by us, we may credit some or all of the diagnostic charge against the repair. This is at our discretion and we will confirm it with you at the time.
8. Parts and materials
We fit original equipment, original equipment supplier or quality aftermarket parts depending on the job, the age of the vehicle and your budget. We will tell you which we intend to use where the choice affects price or warranty.
Parts we supply carry the manufacturer’s warranty. Where a part fails within its warranty period, we will pursue the claim with the supplier on your behalf. Warranty claims usually cover the part itself, and cover for the labour to replace it depends on the supplier’s terms.
Old parts removed from your vehicle are disposed of in line with waste regulations unless you ask us in advance to keep them for you. Parts that must be returned to a supplier under a surcharge or warranty scheme cannot be given to you.
Where a part is ordered specifically for your vehicle and cannot be returned, you remain liable for its cost if you cancel the work after we have ordered it.
9. Parts you supply yourself
We may agree to fit parts you have bought elsewhere, at our discretion. Where we do:
- We give no warranty on the part itself and cannot pursue a warranty claim on your behalf
- Our guarantee under section 16 covers our labour only, and does not cover consequential failure caused by the part
- If the part turns out to be incorrect, faulty or incomplete, the labour time spent up to that point remains chargeable
- If a customer-supplied part fails and damages the vehicle, we are not responsible for that damage
We may decline to fit a customer-supplied part where we consider it unsuitable, unsafe or of uncertain origin. Safety-critical components are the most common reason we decline.
10. Remapping, DPF and AdBlue work, and modifications
This section applies to engine remapping, performance tuning, and any work on diesel particulate filter or AdBlue systems. Please read it carefully, because it places obligations on you as well as on us.
Road legality. We carry out this work on the basis that the vehicle remains compliant with Irish road traffic and emissions law and continues to meet roadworthiness testing requirements. We do not remove, bypass or defeat emissions control equipment on vehicles used on public roads.
Your insurer. A remap or performance modification is a material change to your vehicle. You are responsible for telling your insurer about it. Failure to disclose a modification can invalidate your policy, and that consequence rests with you rather than with us.
Manufacturer warranty. Modifying engine management software may void a manufacturer or extended warranty in whole or in part. We will tell you where we believe this is likely, but the final position is a matter between you and the warranty provider.
Existing condition. Remapping increases load on the engine, clutch, gearbox, turbocharger and related components. Where a vehicle has high mileage, existing wear or an unresolved fault, that additional load can bring forward a failure that was already developing. We will advise you where we have concerns, and we may decline the work. Where you proceed against our advice, we are not liable for the consequences.
Original data. We retain the original calibration file so the vehicle can be returned to its previous state if you ask. See our Privacy Centre for how long we keep it.
DPF and AdBlue servicing. Cleaning, regeneration and repair of these systems is carried out to restore correct function. Where a filter or component is beyond recovery, replacement is the only lawful remedy and we will quote for it.
11. Your vehicle while it is with us
Your vehicle is covered by our motor trade insurance while it is in our custody for the purpose of the work you have authorised.
Please remove personal belongings, valuables, documentation and any aftermarket electronic device before leaving the vehicle. We are not responsible for items left inside it.
Some vehicles have to be left outside the building during a job. Where a vehicle is left with us overnight or across a weekend, it is parked in the most secure position available to us at the time.
You must hold valid motor insurance and motor tax on the vehicle for the entire period it is with us.
12. Test drives
Many faults can only be confirmed or a repair verified on the road. By leaving your vehicle with us you authorise us to drive it on public roads where necessary for diagnosis, repair verification or road testing after work.
Test drives are carried out by our staff, under our motor trade insurance, and are kept to the distance needed to establish or confirm the fault.
If you do not want your vehicle road tested, tell us before you leave it. We will note that on the job card, and we will tell you where declining a road test limits our ability to confirm that a fault has been resolved.
13. Collection, storage and unpaid charges
We will tell you when your vehicle is ready. Please collect it within three working days of that notification, during our opening hours.
After that, we may charge storage at [INSERT DAILY RATE] per day, because workshop and yard space is limited and an uncollected vehicle occupies space another customer needs. We will tell you before storage charges start to run.
Our right of lien. Where an invoice is unpaid, we are entitled at law to retain possession of your vehicle until it is paid. This is a garage keeper’s lien and it applies to charges arising from the work carried out on that vehicle.
Where a vehicle remains uncollected and charges remain unpaid, we will write to you at the address we hold, setting out what is owed and giving you a reasonable period to collect and pay. If the vehicle is still not collected after that period, we reserve the right to take steps to recover what we are owed, including sale of the vehicle where the law permits, applying the proceeds to the outstanding charges and accounting to you for any balance.
14. Payment
Payment is due in full on collection of the vehicle, unless we have agreed account terms with you in writing.
We accept cash, debit and credit cards, and bank transfer. Card payments are handled by our payment provider. We do not store your card details.
Where account terms apply, invoices are due within 30 days of the invoice date. We reserve the right to charge interest and recovery costs on late commercial payments in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations 2012.
Ownership of any part we supply passes to you only once it has been paid for in full.
15. Cancelling a booking
If you want to cancel or move an appointment, please tell us as soon as you can. Where we have already ordered a vehicle-specific or non-returnable part, section 8 applies.
Bookings made at a distance. Where you book by telephone, WhatsApp or email rather than in person, the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 give you 14 days to cancel without giving a reason.
If you ask us to start work within that 14-day period, you are asking for immediate performance. Two things follow. Once the work has been completed in full, the cancellation right is spent. If you cancel part way through, you pay a proportionate amount for the work already carried out and any parts already fitted.
To cancel, contact us using any of the details in section 26. You do not need to use a particular form of words.
16. Our guarantee on work carried out
We guarantee our workmanship for [INSERT PERIOD, for example 12 months or 20,000 km, whichever comes first] from the date of invoice.
If a fault arises that is attributable to work we carried out, bring the vehicle back to us and we will inspect it. Where the fault is down to our work, we will put it right at no charge to you.
The guarantee does not cover:
- Normal wear on components subject to it, including brake pads, discs, tyres, wiper blades and clutch friction material
- Damage caused by accident, misuse, neglect, competition use or lack of routine maintenance
- Faults arising from parts you supplied yourself, as set out in section 9
- Work carried out or altered by another party after we returned the vehicle
- Consequences of you declining work we recommended, where that decision was recorded at the time
This guarantee sits alongside your statutory rights and does not replace them.
17. Your rights as a consumer
If you are dealing with us as a consumer, the Consumer Rights Act 2022 applies to our contract.
That Act requires us to supply services with due skill, care and diligence, using materials that are fit for purpose. If we fall short, you are entitled to remedies which may include having the work put right, a reduction in price, or in some circumstances withholding payment.
Parts we supply to you must be of merchantable quality, fit for their purpose and as described. Where they are not, the Act gives you a short term right to reject, and thereafter rights to repair, replacement, price reduction or refund.
You can find independent information about your consumer rights from the Competition and Consumer Protection Commission at ccpc.ie.
18. Business and fleet customers
Where you are contracting in the course of a business, including fleet, taxi, hire and trade customers, the consumer protections in sections 15 and 17 do not apply to you. The Sale of Goods and Supply of Services Act 1980 governs our contract instead.
For business customers, our total liability is limited as set out in section 20, and we exclude liability for loss of profit, loss of revenue, loss of contracts, vehicle downtime and any indirect or consequential loss.
Where we hold a fleet or account arrangement with you, any written agreement between us takes precedence over these terms to the extent of any conflict.
19. Complaints
If something is not right, tell us first and give us the chance to fix it. Most issues are resolved on the spot when the vehicle is brought back to us.
Contact us by telephone, WhatsApp or email using the details in section 26. We aim to acknowledge a written complaint within five working days and to give you a substantive response within twenty working days. Where a matter needs an inspection or a supplier report, we will tell you and keep you updated.
If we cannot resolve matters between us, you may take the matter to the Small Claims procedure through the Courts Service, which is designed for consumer claims of modest value, or seek independent advice from the Competition and Consumer Protection Commission.
We do not currently subscribe to an alternative dispute resolution body. The European Commission’s Online Dispute Resolution platform closed on 20 July 2025 and is no longer available.
20. Our liability to you
We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any statutory right that cannot be excluded.
Subject to that, our liability for any single job is limited to the value of the invoice for that job, or the cost of putting the defective work right, whichever is the greater.
We are not liable for loss that was not foreseeable at the time we entered into the contract, or for loss arising from a pre-existing fault or condition of the vehicle that we did not cause and were not asked to address.
We are not liable for delay caused by parts availability, supplier lead times, or the discovery of additional work, provided we keep you informed.
21. Events outside our control
We are not responsible for delay or failure to perform caused by something beyond our reasonable control, including supplier failure, industrial action, interruption to power or telecommunications, fire, flood, severe weather, epidemic, or restrictions imposed by a public authority.
Where such an event occurs we will contact you as soon as we can, and we will agree a revised date or, where the delay is substantial, allow you to cancel and receive a refund of anything paid for work not carried out.
22. Data protection
We process personal data about you and your vehicle in order to carry out this contract. How we do that, what we keep, how long we keep it and what rights you have are set out in our Privacy Centre, which forms part of these terms by reference.

24. Changes to these terms

The date at the top of this document shows when it last changed.
25. Governing law
